In Texas, law SB4 introduces criminal liability for “illegal entry,” creating a risk of detention at the state level even before federal immigration proceedings begin. As a result, the formal right to protection is increasingly confronted with the real risk of criminalizing immigration status. At the same time, alongside legal disputes, USCIS is tightening administrative control under H.R. 1. Under rules effective April 28, 2026, the annual asylum fee must be paid within 30 days of notice. Failure to meet the deadline results in rejection of the application. This not only eliminates the basis for extending employment authorization (EAD), but also creates a risk of missing the critical one-year filing deadline. Such an error may make it impossible to obtain status in the future. The contradiction between rights protection in courts and stricter enforcement practices on the ground makes the immigration process a high-risk environment.
